Welcome to Dumbly. By downloading, installing, or using the Dumbly app or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use Dumbly.
1. About Dumbly
Dumbly is a home fitness application that provides structured dumbbell workout challenges (30, 60, and 120 days), AI-powered workout personalisation, exercise video guidance, and progress tracking. The Service is available on iOS (App Store) and Android (Google Play), and via the website at dumbly.app.
2. Eligibility
You must be at least 13 years of age to use Dumbly. By using the Service, you confirm that you meet this requirement. If you are between 13 and 18, you confirm that you have obtained parental consent.
3. Your Account
To access certain features, you must create an account. You agree to:
- Provide accurate and truthful information when registering
- Keep your password confidential and not share it with others
- Notify us immediately at [email protected] if you suspect unauthorised access to your account
- Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions & Payments
Free Plan
Dumbly offers a free tier that includes the 30-Day Beginner Challenge and a limited exercise library. No payment is required.
Dumbly Pro
Pro is available as a monthly or annual subscription and unlocks all challenges, the full exercise library, AI personalisation, and advanced analytics. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
Lifetime Access
A one-time purchase that grants permanent access to all Pro features, including all future updates and new challenges added to the app.
Billing & Cancellation
All purchases are processed through the Apple App Store or Google Play Store. Billing, refunds, and cancellations are governed by Apple's and Google's respective policies. You can manage or cancel your subscription at any time in your device's account settings.
Free Trial
Where offered, a free trial of Dumbly Pro will automatically convert to a paid subscription at the end of the trial period unless cancelled before it ends.
5. Acceptable Use
You agree to use Dumbly only for lawful, personal fitness purposes. You must not:
- Copy, modify, distribute, sell, or reverse engineer any part of the app or its content
- Use the Service to harass, abuse, or harm others
- Attempt to gain unauthorised access to any part of the Service
- Use automated bots or scrapers to extract content from the app
- Misrepresent your identity or impersonate any person or entity
- Use the Service in any way that could damage, disable, or impair it
6. Intellectual Property
All content within Dumbly — including but not limited to workout programs, exercise videos, descriptions, the Dumbly mascot, branding, design, and software — is owned by Dumbly and protected by applicable intellectual property laws. You may not reproduce or distribute any content without our prior written consent.
Your personal workout data remains yours. We do not claim ownership over data you generate through using the app.
7. Health & Fitness Disclaimer
Important: Dumbly is a fitness app, not a medical service.
- Always consult a qualified physician or healthcare professional before beginning any new exercise programme, especially if you have a pre-existing medical condition, injury, or have been physically inactive
- The workouts in Dumbly are designed for general fitness and are not tailored to your specific medical needs
- Stop exercising immediately if you feel pain, dizziness, shortness of breath, or discomfort, and seek medical advice
- Use appropriate weights for your fitness level — do not attempt weights beyond your capability
- Ensure you have adequate space and a safe environment before starting any workout
By using Dumbly, you acknowledge and accept these risks and confirm that you are physically capable of participating in the exercise programmes.
8. Limitation of Liability
To the maximum extent permitted by law, Dumbly shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including personal injury, loss of data, or loss of revenue — arising from your use of the Service or participation in any workout programme.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to Dumbly in the 12 months preceding the claim.
9. Termination
You may delete your account at any time from within the app. We may suspend or terminate your access without notice if you materially breach these Terms. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimer, and limitation of liability survive termination.
10. Changes to These Terms
We may revise these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of Dumbly after changes take effect constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Dumbly shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.
